Every time the state messes up, it reacts by pointing out that it supposedly doesn’t have enough enforcement powers and that citizens have too many freedoms.
Too few cases being solved? No problem—give the police more power to break down doors, physically and digitally.Sexual offenses that can’t be proven? No problem—sex only with explicit consent. But since explicit consent can just as easily be denied afterward, what’s really meant must be verifiable consent, i.e., documented. Those will then be forged, so at some point they’ll have to be notarized. Or should one film it, invite witnesses—would one be enough? Collecting evidence and establishing facts for narrowly defined offenses is too much trouble? No problem—let’s define crimes so broadly and vaguely that reasons for a conviction are easier to find.
We are ruled by people with a huge hunger for power and very little judgment. That is the problem. What might help would be democratically elected judges, chosen by the people with regard to the judgment they are trusted with. The trust that the right candidates will be found through ministerial appointments is, how shall one put it … compromised.
